By accessing or using this website and placing any order, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use this site or place any orders.

1. Introduction

Affordable Jewelery and Precious Metals (“we,” “us,” or “our”) is the seller and merchant of record for all products offered through this site. This site is powered by baseSite, a white-label commerce platform operated by Boston Systems Consulting LLC (“BSC”), which provides software and related technology services to us. BSC is not the seller of any products offered through this site, does not take title to any products, does not hold customer funds, and is not a bank, money transmitter, broker, dealer, custodian, payment partner, or other financial institution. Payment processing, identity verification, fraud screening, sanctions screening, and related financial or compliance functions may be performed by third-party service providers engaged by us, BSC, or both.

2. Nature of Transactions

All products offered through this site are physical precious metals commodities the prices of which fluctuate based on market conditions. By submitting an order, you are making an offer to purchase the selected product(s) at the price displayed at the time of submission, subject to our acceptance. We may accept, reject, delay, limit, or cancel any order in our discretion or as required by law, including in connection with pricing errors, product unavailability, payment issues, identity verification, fraud prevention, sanctions screening, suspected unauthorized activity, or other legal, regulatory, operational, or security concerns. No order is deemed accepted until we have confirmed the order and all applicable payment, verification, and compliance requirements have been satisfied.

3. All Sales Are Final -- No Returns, No Refunds

All accepted sales of precious metals products are final as to you. Because precious metals are market-priced commodities whose value fluctuates, we do not permit returns, refunds, exchanges, or cancellations once an order has been accepted, except as expressly required by law or expressly authorized by us in our sole discretion. Notwithstanding the foregoing, we may cancel, decline, or reverse an order before shipment or settlement completion in cases involving pricing errors, product unavailability, payment failure, failed identity verification, fraud concerns, sanctions or compliance concerns, or other circumstances in which we determine that the order cannot or should not be completed.

By placing an order you acknowledge and agree that:

• Precious metals are market-priced commodities. Like purchasing a stock or other financial instrument, the value may increase or decrease after your purchase. A decline in market value does not entitle you to a return or refund.
• You may sell your precious metals on the open market at any time, but you may not return them to us.
• If we accept your order, the order price will be based on the quoted price at the time the order is submitted, subject to correction of obvious pricing or system errors and subject to these Terms of Service.

4. Unauthorized Return Attempts -- Cost Recovery

If you initiate, attempt, pursue, or assist in a return, chargeback, payment reversal, unauthorized return, ACH reversal, dispute, or any other attempt to reverse or avoid payment for a completed transaction in violation of these Terms of Service, you agree, to the fullest extent permitted by applicable law, to be fully responsible for, and reimburse us, for the actual cost and losses we incur in responding to and resolving the matter, including but not limited to:

• reasonable internal administrative costs,
• reasonable legal fees, collection costs, and court costs,
• Shipping, handling, and logistics costs, and any separately agreed insurance costs actually incurred,
• Administrative and processing fees,
• Any losses resulting from market price changes during the dispute period
• Bank fees, chargeback fees, and payment partner penalties or fees, and
• any market-loss damages resulting from the attempted reversal or delayed recovery of the purchased product or payment.

We reserve all rights and remedies available at law or in equity in connection with any such action. By placing an order you expressly consent to these cost recovery terms and acknowledge that we may pursue all available legal remedies to recover these costs.

5. Payment Processing and Third Party Service Providers

In order to operate this site and process transactions, we may use one or more third-party service providers, including payment partners, banking partners, account-linking providers, identity verification providers, fraud prevention providers, and sanctions screening providers. These providers may include, without limitation, Plaid Inc. (“Plaid”), as well as their respective affiliates, financial institution partners, and other service providers. Your use of certain payment, bank-account, verification, or related functionality may be subject to additional third-party terms, disclosures, privacy notices, and operational requirements.

In order to use the payment functionality made available through our site, you may be required to accept the applicable third-party payment terms. Depending on the payment functionality used, transaction amount, cumulative transaction activity, applicable law, service-provider requirements, or our fraud-prevention, sanctions-screening, security, or compliance determinations, you may be required to complete additional identity verification. If you do not complete required identity verification, you may be treated as an unverified customer, certain payment functionality may be unavailable or limited, the third party partner may not open a full account in your name, and we or our service providers may delay, reject, cancel, or limit transactions. We and our service providers may establish, modify, or apply verification thresholds and requirements from time to time, including where we detect suspicious, unusual, or higher-risk activity.

Where identity verification or compliance review is required, you authorize us and our service providers to collect, use, verify and share the information reasonably necessary for that purpose, which may include your full name, date of birth, social security number, government issued identification, physical address, email address, and payment account and other financial information and other supporting information. You are responsible for the accuracy and completeness of that data.

We may also use Plaid and other third-party service providers to enable you to link bank accounts, verify account ownership, confirm identity, detect fraud, screen transactions, comply with applicable law, and support payment initiation, settlement, reversal, refund, and related account or transaction functions. By using this site and submitting payment or account information, you authorize us and our service providers to collect, receive, use, verify, and share your information as reasonably necessary to provide these services, complete transactions, prevent fraud, conduct sanctions and compliance screening, and comply with legal and regulatory obligations. We and our service providers may delay, reject, cancel, freeze, reverse, or refuse to process a transaction or account activity where required by law, required by a financial institution or service provider, or reasonably deemed necessary for fraud prevention, security, verification, sanctions compliance, or other legal, regulatory, or operational reasons.

If you elect to link a bank account through Plaid or another account-linking provider, you acknowledge that your use of that functionality may also be subject to such provider’s separate terms and privacy disclosures.

6. Identity Verification

To protect against fraud, unauthorized transactions, money laundering, sanctions violations, and other unlawful or prohibited activity, we along with our service providers may require identity verification account verification, payment method verification, sanctions screening, fraud screening, or other compliance review in connection with your account or any order. Such verification may occur at account creation, at the time of order, after order submission, or on an ongoing basis. By using this site, you consent to such verification and screening and you agree to provide, complete, current and accurate information and any documentation reasonably requested for verification and screening purposes, which may include your name, address, date of birth, government-issued identification, tax identification information, payment account information, and other supporting materials. Failure to provide requested information, or any discrepancy or concern identified during review, may result in delayed processing, cancellation of an order, suspension or closure of your account, refusal of service, freezing or reversal of a transaction, or other action deemed appropriate by us or our service providers.

We and our service providers may report or disclose information relating to suspected fraud, sanctions evasion, unlawful conduct, or other suspicious activity to law enforcement, regulators, financial institutions, or other third parties as required or permitted by applicable law.

7. Pricing and Availability; Taxes

All prices, product descriptions, product images, inventory information, availability information, and other content on this site are subject to change without notice. Precious metals prices are based in part on market data and spot pricing, which may change rapidly and may occasionally be delayed, unavailable, or inaccurate due to data feed interruptions, technical issues, or other causes. We reserve the right, in our sole discretion, to correct pricing or listing errors and to reject, limit, delay, or cancel any order for any reason, including pricing errors, stale or inaccurate market data, product unavailability, inventory mismatch, payment issues, failed verification, suspected fraud, suspected unlawful activity, sanctions or compliance concerns, shipping restrictions, or other legal, regulatory, operational, or security reasons.

If we cancel an order after funds have been collected, we will instruct the applicable payment provider to return the amount collected, subject to applicable processing timelines and third-party provider procedures. We do not guarantee that any product, price, premium, promotion, or payment method will remain available for any period of time.

You are responsible for any applicable sales, use, excise, value-added, or similar taxes associated with your purchase, except for taxes based on our net income.

8. Shipping and Delivery

Unless otherwise stated in writing by us, risk of loss and title to purchased products pass to you upon our delivery of the products to the applicable carrier. After that point, we are not responsible for any loss, theft, damage, or delay caused by the shipping carrier or events outside of our reasonable control, including weather, service disruptions, governmental action, labor disruptions, or force majeure events (as detailed below). We may require signature confirmation, adult signature, restricted delivery, or shipment only to verified billing or residential addresses, and may decline to ship to P.O. boxes, freight forwarders, mail drops, or other addresses we deem, in our sole discretion, to be high risk. You are responsible for promptly inspecting any shipment and complying with applicable carrier claims procedures for lost, stolen, damaged, or missing packages. Unless we expressly notify you otherwise, shipments are not separately insured. If you would like separate shipping insurance for a shipment, you must request it before shipment, and we must agree in writing to arrange it at your expense. If separate insurance applies, you agree to cooperate with us and the applicable carrier or insurer in connection with any claim for loss, theft, damage, non-delivery, or other delivery issue. The availability of insurance does not alter the point at which title and risk of loss pass to you under these Terms of Service.

9. Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials, for restricting access to your account and devices, and for all activity that occurs under your account. You agree to provide accurate, current, and complete account information and to update it promptly if it changes. You must notify us immediately of any suspected unauthorized access to or use of your account, credentials, payment methods, or personal information.

10. Prohibited Conduct; Legal Compliance

You may use this site only if you are at least eighteen (18) years old, are legally capable of entering into a binding contract, and are using the site solely for lawful purposes. By accessing or using this site, creating an account, or placing an order, you represent and warrant that you meet these requirements and that all information you provide is true, accurate, current, and complete.

You may not use this site or any account, product, or service offered through this site for any unlawful, fraudulent, deceptive, abusive, evasive, or otherwise improper purpose. Without limiting the foregoing, you may not use this site to engage in fraud, identity theft, money laundering, sanctions evasion, unauthorized account activity, payment abuse, chargeback abuse, attempted circumvention of verification or screening procedures, use of false or misleading information, interference with the operation or security of the site, or any other activity that violates applicable law, these Terms of Service, or the rights of any third party.

You represent and warrant that you are not located in, ordinarily resident in, or acting on behalf of any person or entity located in a jurisdiction subject to comprehensive U.S. sanctions, and that you are not a person or entity with whom we are prohibited from dealing under applicable law.

We reserve the right to refuse service, decline or cancel orders, block transactions, suspend or terminate accounts, or take any other action we deem appropriate if we believe, in our sole discretion, that you or any transaction may violate applicable law, these Terms of Service, or our fraud-prevention, sanctions-screening, security, or compliance requirements.

11. Electronic Consent; SMS Authentication Codes

By using this site, creating an account, or placing an order, you consent to receive communications from us electronically, including by email, through your account, and, where applicable, by text message. You agree that such electronic communications satisfy any legal requirement that communications be in writing.

When you create an account and provide a mobile phone number, you expressly consent to receive automated text messages (SMS) from Boston Systems Consulting LLC, our technology provider, containing one-time sign-on verification codes and other security- related authentication codes. These messages are transactional and security-related, not marketing messages. Message and data rates may apply. Message frequency varies based on your account activity and sign-in events.

These authentication messages are required to operate your account securely and cannot be opted out of while your account remains active. To stop receiving these messages you must close your account by contacting sales@ajpm.com. You may also reply STOP to unsubscribe from Boston Systems Consulting LLC; doing so will disable your ability to sign in and may result in your account being suspended. 12. Orders; Payment Authorization; Holds and Reversals

By submitting an order, you authorize us and our payment, banking, and financial service providers to initiate, receive, process, complete, reverse, credit, refund, or debit transactions as necessary to complete, correct, cancel, or unwind your order or related payment activity. You acknowledge that payment authorization, settlement, and final funds availability may take time and may be subject to review, return, reversal, or rejection by banks, payment partners, card networks, or other financial intermediaries.

We may delay fulfillment or shipment until payment is verified, cleared, or deemed final in our sole discretion. We and our service providers may place holds on transactions, decline payment methods, reject orders, reverse payments, or require additional verification where necessary for fraud prevention, security, legal compliance, sanctions screening, or operational reasons.

13. Privacy and Information Sharing

By using this site, creating an account, or placing an order, you acknowledge that we, BSC, and their and our service providers may collect, use, process, store, and share your information as described in our Privacy Policy (which is incorporated into these Terms of Service by reference) and as reasonably necessary to operate the site, process transactions, verify identity, prevent fraud, comply with law, communicate with you, fulfill orders, and support your account.

Information may be shared with payment partners, banks, identity verification providers, fraud prevention providers, sanctions screening providers, cloud hosting providers, shipping and logistics providers, customer support providers, law enforcement, regulators, and other third parties where necessary to provide services or comply with legal obligations.

14. No Investment or Financial Advice

NOTHING ON THIS SITE CONSTITUTES OR SHOULD BE CONSTRUED AS INVESTMENT, FINANCIAL, LEGAL, TAX, OR OTHER PROFESSIONAL ADVICE. Purchasing precious metals is inherently risky. The value of precious metals may rise or fall, sometimes quickly and significantly, based on market and economic conditions beyond our control. We do not guarantee any profit, appreciation in value, or protection against loss. You are solely responsible for evaluating any purchase decision and for determining whether a purchase is appropriate for your own circumstances, and you should consult your own professional, financial, legal, and tax advisors as appropriate.

15. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages or for any loss of profits, revenue, business opportunity, data, goodwill, or market value, arising out of or related to your use of this site or any transaction, order or any product.

Without limiting the foregoing, we shall not be liable for delays, interruptions, errors, pricing feed issues, data inaccuracies, product unavailability, failed deliveries, carrier delays, account access issues, payment partner actions, bank holds, ACH returns, chargebacks, sanctions screening outcomes, identity verification failures, suspected fraud reviews, or other acts or omissions of third-party service providers.

To the maximum extent permitted by law, our total liability arising out of or relating to any order or transaction shall not exceed the amount actually paid by you to us for the specific product(s) giving rise to the claim.

16. Indemnification

You agree to indemnify, defend, and hold harmless us, BSC, and our and their respective affiliates, service providers, officers, directors, employees, agents, successors, and assigns from and against any third-party claims, losses, liabilities, damages, judgments, penalties, fines, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to your breach of these Terms of Service, your misuse of the site, your violation of applicable law, your fraud or willful misconduct, or your infringement or violation of any rights of any person or entity. This indemnification obligation applies only to the extent permitted by applicable law and does not apply to claims resulting from our gross negligence, willful misconduct, or violation of law.

17. Disclaimers

This site and all content, information, tools, and functionality made available through it are provided on an “as is” and “as available” basis, without warranties of any kind except as expressly required by applicable law.

18. Suspension or Termination of Access.

We may suspend or terminate your access to the site or your account at any time, with or without notice, if we believe that you have violated these Terms of Service, provided inaccurate information, failed verification, engaged in fraud or unlawful activity, or otherwise created legal, security, or operational risk. Suspension or termination does not affect obligations that arose before termination or any provisions that by their nature should survive.

19. Force Majeure

We will not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, carrier delays, telecommunications or internet failures, outages of payment or banking partners, governmental actions, or other force majeure events.

20. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles. Any dispute arising under these Terms, your use of the site, or any order or transaction shall be brought exclusively in the courts in the state or federal courts located in Massachusetts, and you consent to the personal jurisdiction and venue of those courts.

21. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Changes will apply prospectively from the date posted unless otherwise stated. Your continued use of the site after any changes constitutes acceptance of the revised terms.

22. Severability

If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

23. No Waiver; Cumulative Remedies.

Our failure or delay in exercising any right, remedy, power, or privilege under these Terms of Service will not operate as a waiver of that right, remedy, power, or privilege. Any waiver must be in writing and signed by us to be effective. Except as expressly stated otherwise in these Terms of Service, all rights and remedies available to us under these Terms of Service or by law or in equity are cumulative and may be exercised separately or together.
